Terms of Service
TERMS OF SERVICE
Liberty Tattoo Supply, LLC
1 AGREEMENT AND SCOPE
These Terms of Service (“Terms”) govern your use of the online store operated by Liberty Tattoo Supply, LLC (“Liberty,” “we,” “us,” or “our”) and purchases made through that store, including purchases of Vulcan Needles and other Vulcan-branded products. “You” means the person using the store and, when that person acts for a business with authority, that business. These Terms apply to websites on which Liberty identifies itself as the seller and provides these Terms.
By affirmatively accepting these Terms at checkout or during account registration, you agree to them. Website use is subject to these Terms when they are presented with legally sufficient notice and acceptance. If you do not agree, do not place an order or use services requiring acceptance. You may save or print a copy.
The Returns Policy at https://www.libertytattoosupply.com/pages/returns-policy is incorporated as supplemented by Sections 8 through 10. The Privacy Statement at https://www.libertytattoosupply.com/pages/privacy-statement describes our handling of personal information. Specific shipping and promotional terms clearly disclosed before purchase also apply. Section 21 explains which terms control if provisions conflict. Nothing in these Terms waives rights or obligations that applicable law does not permit the parties to waive.
2 PROFESSIONAL PURCHASERS AND VERIFICATION
Our tattoo products are intended for professional use. By ordering, you represent that you are at least 18 and the age of majority where you live, have authority to enter this agreement, and are a professional tattoo artist, a person purchasing for a professional tattoo establishment, an authorized reseller, or another purchaser expressly approved by Liberty. You must hold the individual or establishment licenses and permits required where you operate; an individual artist license is not required by these Terms where local law does not require one.
We may request reasonable evidence of professional status, business registration, applicable licensing, or purchasing authority. Provide accurate information and cooperate with verification. Do not submit client health records or unnecessary sensitive information. Verification does not certify your competence or relieve you of professional obligations.
We may decline or cancel an order if we cannot reasonably verify eligibility or suspect unlawful use, fraud, or unauthorized resale. We will notify you and refund all amounts collected for an entirely unshipped canceled order, including shipping and taxes. No restocking or verification fee applies to an order canceled before shipment for failed verification. Verification does not extend applicable shipping deadlines without the notice and consent required by Section 6.
3 ACCOUNTS AND PERMITTED USE
Provide current, complete contact, billing, shipping, and business information. Keep credentials secure and promptly notify us of suspected unauthorized account activity. You are responsible for activity you authorize; this provision does not make you automatically liable for activity caused by our failure to meet our legal obligations.
You may not use the store or products unlawfully; misrepresent your identity, credentials, or payment authority; introduce malware; interfere with security or availability; collect another person’s personal information without lawful authority; or infringe intellectual property rights. Unauthorized bulk extraction of site content, spam, impersonation, threats, and unlawful harassment are prohibited. These restrictions do not prohibit lawful accessibility tools, legally protected activity, or honest reviews.
4 PRODUCTS PRICES AND ORDER ACCEPTANCE
Product descriptions, specifications, prices, availability, and offers may change prospectively. Images are illustrative, and screen colors may vary; these qualifications do not permit materially different products or excuse inaccurate material descriptions. Prices are in U.S. dollars unless expressly stated otherwise. Applicable shipping charges and taxes are disclosed before you submit payment. You are responsible for providing valid tax-exemption documentation when claiming an exemption.
Your order is an offer to purchase. An automated receipt acknowledges receipt and does not by itself accept the order. We accept an order when we send an express acceptance or shipment confirmation, subject to applicable law. Collection of payment before shipment does not excuse our shipment, cancellation, or refund duties. We may impose reasonable quantity or geographic restrictions disclosed before purchase and may reject orders for legitimate inventory, eligibility, legal, or fraud concerns.
If a material pricing, description, or availability error affects an order, we will notify you and offer correction with your agreement or cancellation and the refund required by law. We will not impose a higher price or materially substitute products without your agreement. Price changes do not retroactively alter accepted orders. You may request cancellation before shipment; if shipment has already occurred, the return provisions apply, without limiting statutory cancellation rights.
5 PAYMENT SHOPIFY AND FRAUD PREVENTION
Shopify supplies our e-commerce platform. Liberty is the seller for purchases from our store. Payment processors, accelerated checkout services, and financing providers may apply separate terms to their services. Their terms do not eliminate Liberty’s obligations as seller. You authorize charges for the total disclosed at checkout using a payment method you are authorized to use.
We and our service providers may use billing-address checks, payment authentication, and fraud screening. We may request reasonable verification, decline payment, hold fulfillment for verification, or cancel a suspicious transaction. A screening result is not conclusive proof of fraud. Holds remain subject to Section 6. We will release authorizations or refund collected funds for canceled orders as appropriate; financial institutions control when released funds become available.
Do not send full payment-card numbers or security codes by email. Use the secure checkout or another payment method we expressly provide. Please contact us about billing problems so we can investigate. Nothing requires you to contact us before exercising payment-dispute rights, shortens an issuer deadline, or penalizes a good-faith chargeback. You may not obtain duplicate reimbursement for the same loss.
6 SHIPPING TIMES PREORDERS AND BACKORDERS
We will have a reasonable basis for stated shipment times. If no shipment time is stated, we will ship within 30 days after receipt of a properly completed order, unless a different period is permitted by applicable law. A carrier transit estimate describes time after shipment and does not replace a stated dispatch commitment. Preorders and backorders will be identified with their anticipated shipment timing before purchase when known.
If we cannot ship on time, we will provide a timely delay notice, a revised shipment date or an explanation that no date can be given, and a no-cost way to cancel for a full and prompt refund for unshipped merchandise. We will seek your affirmative consent to a delay and state the response deadline. If you do not agree by that deadline and we have not shipped within the applicable period, we will cancel the unshipped portion and refund it. Further delays require renewed notice and consent when required. You may cancel an agreed indefinite backorder at any time before shipment.
Refunds required by the FTC Mail, Internet, or Telephone Order Merchandise Rule will be made within that Rule’s applicable deadlines, generally seven working days for payments through third-party credit and other ordinary payment methods, and one billing cycle where Liberty itself is the creditor. We will refund applicable taxes and shipping or other charges attributable to unshipped merchandise; if nothing ships, we will refund the full amount paid. We will not replace a legally required monetary refund with store credit. No replacement item or additional split-shipment charge will be imposed without your agreement.
7 DELIVERY AND SHIPMENT CLAIMS
Provide a complete and accurate delivery address and any necessary access instructions. Tell us promptly if an address is wrong. Changes after shipment may not be possible. Reasonable, documented redirection or reshipment charges caused by an address error you supplied require disclosure and your agreement before we arrange the additional service. Carrier delivery dates are estimates unless we expressly provide a guarantee.
For ordinary website orders, Liberty bears transit loss and damage risk until delivery to the agreed address and recipient or an authorized delivery location consistent with your instructions. A carrier scan is evidence of delivery, not conclusive proof. Notify us promptly of nonreceipt, misdelivery, damage, missing items, or suspected theft. Where feasible, contact us within seven days after discovering a problem; this is a requested reporting target, not an automatic forfeiture of claims or a shortened legal limitation period.
Include the order number, a description, and available photos of the package, label, and damage. Retain packaging and affected merchandise when safe, and reasonably cooperate with our investigation. We may review tracking, delivery photos, signatures, and other evidence. You do not have to purchase optional shipping protection to preserve our obligations or your legal rights.
We will arrange an appropriate replacement or refund for confirmed transit loss, misdelivery, damage, or fulfillment error for which we are responsible. Your remedy will not depend on our receiving reimbursement from the carrier. Theft after valid delivery will be evaluated on the facts, any applicable protection coverage, and applicable law; it does not automatically establish either liability or a denial of relief. Contact Liberty directly even if a carrier or third-party protection provider is also investigating.
For international orders we accept, import duties, taxes, and clearance responsibilities will be disclosed where applicable. You must comply with lawful import requirements. We will not misstate value or contents. Any refusal or customs problem will be handled under applicable law and disclosed order terms, without automatic forfeiture of the entire payment.
8 DISCRETIONARY RETURNS AND EXCHANGES
For a change-of-mind return, request authorization within 30 days after delivery. Eligible goods must be unused, unopened where hygiene or sterility is relevant, in original saleable condition and packaging, with included parts and promotional items. Provide an order number or other reasonable proof of purchase. Contact us before shipping so we can confirm eligibility and safe return instructions.
Opened sterile or sanitary goods, used products, products with compromised hygiene seals, and hazardous or flammable goods are not eligible for discretionary returns. Gift cards are nonreturnable except where law requires otherwise. Goods clearly identified as final sale before purchase are not eligible for change-of-mind returns. These exclusions do not bar claims involving defects, incorrect goods, transit damage, recalls, or nonwaivable rights.
For an authorized discretionary return, you pay return shipping and original shipping is not refundable, except where law requires otherwise or we agree otherwise. No restocking fee applies under these Terms. We will explain any proposed reduction for missing components or customer-caused damage and will not deduct amounts attributable to our error. Use a suitable tracked service and retain proof of shipment.
We will inspect an authorized return and communicate approval or the reason for denial. Approved discretionary refunds will be initiated to the original payment method within 15 business days after receipt and inspection, subject to any shorter legal deadline; inspection will occur without unreasonable delay. A replacement or store credit may be provided instead if you agree. Sections 6, 7, 9, and 10 govern their respective claims and override inconsistent discretionary return restrictions, fees, or processing periods in the linked Returns Policy.
9 DEFECTIVE INCORRECT AND UNSAFE MERCHANDISE
Inspect products on receipt and before use. Report defects, incorrect items, shortages, compromised sterile packaging, or suspected contamination promptly after discovery. The discretionary return window does not determine the time for a latent-defect or warranty claim. Applicable warranty terms and legal notice requirements govern those claims.
Stop using a suspect product and retain its packaging, lot or batch number, expiration information, and relevant photographs when safe. Do not ship used needles, contaminated products, biological material, or hazardous goods without our express safe-handling instructions. We may arrange photographs, safe disposal, or another reasonable verification method instead of a physical return.
For a verified defect or fulfillment error for which we are responsible, we will provide an appropriate repair, replacement, or refund consistent with any applicable warranty and law, and cover reasonable authorized return shipping. We will not charge a restocking fee for these claims. These procedures are not your exclusive legal remedy. We may help coordinate a manufacturer’s warranty claim, but referral to a manufacturer does not release Liberty from its own obligations. See Section 17 for warranties and Section 18 for limitations and exceptions.
10 RECALLS AND SAFETY COMMUNICATIONS
If a manufacturer, regulator, or Liberty identifies a recall or other safety action affecting your products, follow applicable stop-use, quarantine, return, and disposal instructions. Do not use or redistribute recalled goods. Reasonably cooperate in identifying affected products and notifying recipients to whom you supplied them when required by law or an applicable reseller agreement.
Keep contact information current so we can send safety notices. Preserve lot and transaction records as required by applicable law and your professional obligations. Recall remedies and shipping or disposal arrangements will follow the applicable recall instructions and law; ordinary return exclusions do not limit them. Report suspected safety incidents to Liberty promptly. Nothing restricts reports to regulators or emergency services, or transfers our reporting obligations to you.
11 PROFESSIONAL PRODUCT SAFETY RESPONSIBILITIES
Select and use products only for their intended purposes and within your professional competence. Follow current manufacturer labels, instructions, warnings, safety data sheets, expiration dates, storage conditions, and applicable licensing, sanitation, infection-control, sharps-disposal, and workplace-safety rules. You are responsible for required client assessment, consent, and procedure-specific precautions.
Before use, inspect the product and any sterile barrier. Do not use expired, damaged, contaminated, recalled, or improperly stored goods, or goods whose sterile packaging is open or compromised. Products labeled single-use must not be reused or reprocessed. Do not modify products or remove safety and traceability information. Website descriptions and general educational content do not replace product instructions or professional training.
Liberty sells third-party products and Vulcan-branded products. A product’s label and applicable documentation identify its manufacturer and responsible parties. These Terms do not represent that Liberty manufactures every item, or that it acts only as a distributor for every Vulcan product. Professional-use requirements do not disclaim our own legal duties, guarantee product safety, or release product-liability claims that cannot lawfully be limited.
12 PROMOTIONS DISCOUNTS AND CREDITS
Offer-specific terms disclosed before redemption govern eligibility, dates, minimum purchases, product exclusions, quantity limits, and combination with other offers. Discounts cannot be combined unless the offer permits it. We may correct a genuine calculation error or reject fraudulent or ineligible redemption, with notice and an appropriate opportunity to cancel where an order is affected. We will not retroactively remove an earned benefit from an accepted order simply because an offer later changes.
Purchased gift cards and purchased store value represent amounts paid. Under these Terms they do not expire and carry no inactivity or maintenance fee. They are redeemable for eligible purchases and are not redeemable for cash except as required by law. Safeguard codes and report suspected unauthorized use; we will investigate using reasonable proof of ownership and available records.
Refund credit is value issued for returned goods or another amount owed to you. We will not force you to accept refund credit where a monetary refund is required. Refund credit you agree to accept does not expire or incur inactivity fees under these Terms. It is not promotional credit.
Promotional credit is value provided without payment as a marketing incentive. Only lawful eligibility restrictions and expiration dates clearly disclosed when issued apply; if no expiration is disclosed, none applies. Promotional value has no cash redemption value except as required by law. It will be identified separately from purchased value and refund credit. Classification depends on the transaction and applicable law, not merely its label. Returns of discounted items are based on the amount actually paid, with any bundle allocation disclosed before purchase; legally required refunds and compensation for redeemed promotional value remain available.
13 RESALE AND WHOLESALE RELATIONSHIPS
A retail purchase does not appoint you as a dealer, distributor, agent, or representative of Liberty or grant trademark or marketing rights. We may decline future orders reasonably believed to involve unauthorized resale, diversion, unlawful activity, or misuse of our brands, subject to applicable law. We do not impose resale pricing, exclusive territories, or minimum advertised pricing through these Terms.
Authorized wholesale and distribution relationships are governed by separately executed agreements. Those agreements control conflicting provisions for transactions within their scope. Website purchases do not amend an existing signed wholesale agreement unless the parties expressly agree. Nothing in these Terms purports to bind a person who has not agreed to them or eliminates rights that applicable law gives purchasers of genuine goods.
14 INTELLECTUAL PROPERTY
Liberty, Vulcan, and third-party names, trademarks, logos, product photographs, text, graphics, and other store content belong to their respective owners. You may view content and retain reasonable copies for evaluating purchases, using purchased products, and keeping transaction records. Other reproduction, commercial distribution, or use suggesting sponsorship requires the rights holder’s permission, except as permitted by law. Purchase of a product does not grant a license to Liberty’s or a third party’s intellectual property beyond rights accompanying lawful use or resale under applicable law.
15 REVIEWS FEEDBACK AND SUBMITTED CONTENT
You retain ownership of your reviews, photographs, and other submissions. For content you submit for public display, you grant Liberty a nonexclusive, worldwide, royalty-free license to host, reproduce, display, and make technical formatting changes necessary to publish it, respond to it, and promote the reviewed products or our store. We may allow service providers to exercise those rights solely for those purposes. The license does not authorize alteration of your substantive opinion, a false endorsement, or use of private support communications as public marketing without separate permission.
Submit only content you have the right to share. Do not include private client information or identifiable client images without legally sufficient permission. Reviews must reflect actual experience; disclose any material connection or incentive. We do not condition incentives on positive sentiment, require transfer of review ownership, prohibit honest criticism, or impose a fee or other penalty for an honest review.
We may moderate unlawful, infringing, abusive, clearly false, irrelevant, or privacy-violating material using lawful, evenhanded criteria. A negative opinion alone is not grounds for removal. We will not edit a review to misrepresent its meaning. Contact us about a rights complaint or removal request; we will assess it under applicable law and legitimate recordkeeping requirements. Suggestions do not create a right to compensation absent a separate agreement.
16 PRIVACY ACCESSIBILITY AND THIRD PARTY SERVICES
Our Privacy Statement is available at https://www.libertytattoosupply.com/pages/privacy-statement. It explains information practices and contact options. Acceptance of these Terms is not separate consent to optional marketing or processing for which law requires additional consent. Transaction and safety communications may be sent using the contact details you provide, as permitted by law.
If you encounter an accessibility barrier or need product information or assistance in an alternative format, email Sales@LibertyTattooSupply.com or call (888) 882-8866. Identify the relevant page or task and the assistance needed, without including unnecessary sensitive information. We will work with you to provide reasonable assistance. This process does not limit accessibility rights or require you to waive a claim.
Optional third-party tools, financing, and external websites may have their own terms and privacy practices. Review them before use. A link does not by itself imply endorsement. We do not control independent third-party services and do not guarantee their availability or accuracy, but this provision does not disclaim our responsibility for services we provide, our own representations, or obligations imposed by law.
17 WARRANTIES AND DISCLAIMERS
Express warranties provided with a product or arising under applicable law remain effective according to their terms. Any manufacturer warranty is that manufacturer’s undertaking; Liberty’s own express warranties and legal obligations remain separate. These Terms do not negate factual product descriptions, affirmations, or promises that create an enforceable express warranty.
EXCEPT FOR EXPRESS WARRANTIES AND RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, LIBERTY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE EXTENT PERMITTED BY APPLICABLE LAW. THIS DISCLAIMER DOES NOT APPLY WHERE LAW PROHIBITS IT, INCLUDING WHERE AN APPLICABLE WRITTEN WARRANTY OR SERVICE CONTRACT PREVENTS SUCH A DISCLAIMER.
SUBJECT TO THE SAME EXCEPTIONS, THE WEBSITE AND OPTIONAL ONLINE TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT GENERAL WEBSITE CONTENT WILL MEET EVERY USER’S NEEDS. THIS WEBSITE DISCLAIMER DOES NOT ELIMINATE OUR PRODUCT, PAYMENT, SECURITY, REFUND, OR OTHER NONWAIVABLE OBLIGATIONS.
If an applicable limited remedy fails of its essential purpose, remedies available under applicable law remain available. You may have additional rights that vary by jurisdiction. Section 18 states the exceptions to our liability limitations.
18 LIMITATIONS OF LIABILITY
TO THE EXTENT PERMITTED BY LAW AND SUBJECT TO THE EXCEPTIONS BELOW, LIBERTY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS, OR LOST DATA, ARISING FROM THE STORE OR PRODUCTS, WHETHER A CLAIM SOUNDS IN CONTRACT, TORT, OR ANOTHER LEGAL THEORY, EVEN IF SUCH DAMAGES WERE FORESEEABLE.
SUBJECT TO THE SAME EXCEPTIONS, LIBERTY’S TOTAL LIABILITY FOR A CLAIM OR RELATED CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO LIBERTY FOR THE ORDER OR ORDERS GIVING RISE TO THE CLAIM, INCLUDING TAXES AND SHIPPING, OR (B) $100.
THESE EXCLUSIONS AND CAP DO NOT APPLY TO DEATH OR PERSONAL INJURY; DAMAGE TO TANGIBLE PROPERTY OTHER THAN THE PRODUCT ITSELF; FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE; LIBERTY’S REFUND OR PAYMENT OBLIGATIONS UNDER THESE TERMS; OR LIABILITY OR REMEDIES THAT APPLICABLE LAW PROHIBITS US FROM LIMITING. THEY DO NOT REDUCE AN EXPRESS WARRANTY REMEDY OR A REMEDY REQUIRED WHEN A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. IF YOUR JURISDICTION DOES NOT ALLOW A PARTICULAR LIMITATION, THAT LIMITATION DOES NOT APPLY TO YOU.
19 BUSINESS PURCHASER INDEMNITY
If you purchase for business purposes, you will indemnify Liberty and its officers and employees against third-party claims, damages, and reasonable defense expenses to the extent caused by your unlawful product use, material breach of these Terms, or infringement of third-party rights through content you submit. This obligation does not apply to the extent a claim results from a product defect for which Liberty is responsible, Liberty’s negligence or misconduct, or Liberty’s breach of law or these Terms. It does not apply to your good-faith assertion of your own rights.
Liberty will give reasonably prompt notice of a covered claim, allow you to conduct the defense with reasonably acceptable counsel, and provide reasonable cooperation at your expense. Late notice relieves your obligations only to the extent of material prejudice. No settlement may admit fault by Liberty, impose nonmonetary obligations on it, or fail to release it fully without Liberty’s written consent, not unreasonably withheld. Liberty may participate with its own counsel at its own expense unless a conflict of interest requires a different allocation under law.
20 SUSPENSION TERMINATION AND INTERRUPTIONS
We may suspend access or cancel an unfulfilled order for a material breach, credible security or fraud concern, legal requirement, or discontinuation of the relevant service. We will provide notice and an opportunity to resolve a remediable issue when reasonably practicable. Immediate action may be taken where needed to protect people, systems, or legal compliance. Service decisions will comply with applicable nondiscrimination law.
You may stop using the store and request account closure. Closure or suspension does not cancel accrued payment obligations, refund entitlements, accepted orders, warranty claims, or nonwaivable rights. Provisions concerning accrued rights, intellectual property, submitted-content licenses, liability, indemnity, and disputes survive to the extent necessary to give them effect.
Events beyond reasonable control may affect operations. We will communicate material fulfillment delays and follow Section 6. Such events do not authorize indefinite retention of payment for unshipped goods or excuse legally required notices, consent, refunds, or safety duties.
21 ENTIRE AGREEMENT AND PRIORITY
These Terms, the policies and transaction terms expressly incorporated in Section 1, and applicable signed agreements constitute the agreement on their subject matter. In a conflict, applicable nonwaivable law controls first, then a separately signed agreement for the transaction, then a specific written product warranty or order term expressly agreed by both parties, then these Terms, then other incorporated policies. A specific provision does not override a nonwaivable right. The Privacy Statement governs descriptions of personal-information practices and does not create consent where separate consent is required.
Unilateral purchase-order terms do not modify this agreement without Liberty’s express acceptance. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be severed to the extent necessary, and the rest remains effective unless doing so would defeat the agreement’s essential purpose. Neither party gains broader rights from an unenforceable provision.
22 GOVERNING LAW AND DISPUTES
North Carolina law governs these Terms and transactions, without applying conflict-of-law rules that would select another jurisdiction’s law. Mandatory protections that apply to you remain available. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
We encourage you to contact Sales@LibertyTattooSupply.com with a description of a dispute and the remedy requested so we can seek an informal resolution. This is voluntary and is not a prerequisite to suit, a payment dispute, a regulator complaint, or urgent relief. It does not suspend or shorten any filing deadline.
Except where mandatory law provides otherwise, the parties consent to exclusive jurisdiction and venue in the state courts located in Wake County, North Carolina, or, if federal subject-matter jurisdiction exists, the United States District Court for the Eastern District of North Carolina. Either party may use an otherwise competent small-claims court where permitted by law. These Terms do not impose mandatory arbitration, waive a jury trial, or waive participation in a class proceeding. Each party bears its own legal fees unless applicable law or another enforceable agreement provides otherwise.
23 CHANGES NOTICES AND CONTACT
Revisions apply prospectively from the effective date identified with the published revision. We will provide legally required notice of material changes and obtain renewed acceptance where required. The version accepted for an order governs that order; later revisions do not retroactively change existing disputes, warranties, or accrued rights. Mere publication does not replace any legally required notice or consent.
For questions, orders, returns, safety concerns, accessibility assistance, or informal dispute notices, contact Liberty Tattoo Supply, LLC using the details below. Obtain return authorization and shipping instructions before sending merchandise. These contacts are for business communications and do not replace formal legal service requirements.
